Background
The Mortgage Testing and Education Board (MTEB) has approved Rules of Conduct which cover test takers and Standards of Conduct which cover course providers. It has also approved Administrative Action Procedures which prescribe how it will provide oversight of test takers and course providers and specifically how it will administer disciplinary actions regarding those persons or organizations who may violate the rules and standards of conduct.
Rules of Conduct for Test Takers
All state licensed Mortgage Loan Originators are required to take and pass the SAFE MLO Test- National and State Components. Any person who uses NMLS to enroll and pay for a test then subsequently schedules and takes a test component, is subject to the Rules of Conduct. All persons who attempt to take the SAFE MLO test will be asked to acknowledge that they have read and agree to the Rules of Conduct. Persons who are believed to have violated the Rules of Conduct may be subject to investigation by the MTEB. Depending on the outcome of its investigation, MTEB may refer its finding to the appropriate state agencies for further action by the agencies.
Standards of Conduct for Course Providers
Under the SAFE Act, NMLS has sole authority to approve courses which state licensed MLOs must take to satisfy their PE and CE requirements. All organizations which apply to become course providers and those organizations which are approved, are subject to the Standards of Conduct. Organizations which violate the standards may be subject to investigation by the MTEB. After following the Administrative Action Procedures, the MTEB may sanction providers for violations of the Standards of Conduct.
Administrative Action Procedures
The MTEB has created the Administrative Action Procedures to guide its oversight of test takers and course providers. It provides the processes by which it will enforce the standards and rules of conduct including disciplinary actions it may take against those violating the rules and standards of conduct. It also describes the rights persons and organizations have if they should become the subject of an investigation by the MTEB.
The Mortgage Testing and Education Board
The MTEB was created by the State Regulatory Registry LLC Board of Managers (SRR BOM) in September, 2009. The MTEB is responsible for the oversight of SAFE required testing and course approvals and related activities including the development and implementation of the Administrative Action Procedures. The MTEB also acts in an advisory capacity regarding the policies and procedures by which NMLS meets the SAFE Act testing and education requirements. The MTEB is composed of nine individuals (each from a state mortgage regulatory agency) appointed by the SRR BOM.
